2. Term ‘personal data’
‘Personal data’ includes all information that pertains to an identified or an identifiable natural person. Such can, in particular, include, but is not limited to: name, date of birth, email address, telephone number, and gender.
3. Controller and service provider
The controller within the meaning of data protection law and simultaneously the service provider within the meaning of the Telemediengesetz (the Telemedia Act, the “TMG”) for this website and for the MÁ online shop is: Felde Vertrieb GmbH, Lerchenstraße 93, 22767 Hamburg, Germany, registered at the Commercial Register of the Local Court of Hamburg, HRB B 152637, managing directors: Ulrik Schiötz (“MÁ”).
4. Processing of personal data
Personal data are processed and shared by MÁ only if such is prescribed or allowed by law or if the user has consented thereto.
The scope and the nature of the collection and use of your data differ depending upon whether you visit our website only to retrieve information or to make use of services offered by us:
4.1 Use of the website and of the MÁ online shop
To the extent that you make use of the offers provided on our website and place orders in the MÁ online shop, it will be necessary for you to provide personal data. These data are what the respective transaction requires. The processing of your data is effected for the purpose of rendering the service you want, such as sending you the desired email newsletter or carrying out the order in the MÁ online shop, and making information available in your MÁ online shop customer account. MÁ will process your personal information in the scope described below.
4.1.1 Informational use of the website
Generally, it is not necessary for you to furnish personal data just to visit our website or the MÁ online shop (informational use). Apart from such, (5.1.2) through (5.1.5) shall apply.
Rather, in this event MÁ will process only those data that your internet browser automatically transfers to us, e.g.:
• date and time of the retrieval of one of our websites
• the requested site and method
• the type of browser used
• the browser settings
• the operating system used
• the site most recently visited by you
• your IP address and the port
• as well as any additional transfer-relevant parameters
We process these data (i) in order to enable or to optimize use of the internet sites retrieved by you, (ii) for statistical purposes, and (iii) to improve the offerings of MÁ on the internet. We store the IP address only for the duration of your visit to our website or the MÁ online shop; no personal evaluation takes place.
Our website is operated by (hosted at) Agent ERP GmbH, Balduinstraße 24, 20359 Hamburg, so that the data mentioned here are transferred for operation of our website to Agent ERP GmbH.
4.1.2 Ordering with customer account
On this website, MÁ offers you the opportunity to set up a customer account for the MÁ online shop. You can store your personal information here for orders in the MÁ online shop, in order to be able to order more conveniently and more quickly in the future. At the same time, service information will be kept ready for you in your personal customer account, e.g., access to your purchasing history.
When your customer account is registered, MÁ will set up password-protected access to your personal master data (particularly salutation, name, address, date of birth, telephone number, email address) and ordering data (e.g., goods, payment dates, shipping service providers).
By setting up a personal customer account, you hereby consent (Article 6(1)(a) of the General Data Protection Regulation, the “GDPR”) to having MÁ store the deposited master and ordering data and connect it with your customer account.
You can rectify or erase the data in the customer account yourself at any time. Moreover, at any time you can revoke the above consent for setting up a customer account and have the MÁ customer account erased. To do so, you only have to send MÁ the relevant declaration in the text-form (Textform) (see “Contact us”), and no costs will be incurred aside from any ordinary transmittal costs of the communication method you choose. MÁ will then promptly erase your customer account. Please note that through the erasure, only the customer account and the information connected to it are erased, and that the erasure does not pertain to the order transactions and to the actual personal data stored concerning placed orders.
MÁ processes the personal data provided by you to maintain the customer account until such time as it is erased. The personal data that are stored in connection with an order from MÁ are processed by MÁ in fulfillment of the contract entered into with you or to carry out pre-contractual measures (Article 6(1)(b) GDPR) and accordingly are further stored in the customer account; apart from that, they are erased, to the extent that retention is not prescribed by law. In the latter event, the data are erased upon expiration of the retention period.
4.1.3 Ordering as guest
If you wish to use the MÁ online shop without a personal customer account, then you can also place an order as a guest. To do so, in each instance the necessary personal master and ordering data that are part of the ordering procedure have to be entered on the online order form from the MÁ online shop. Here, the same data are processed as when a personal customer account is set up.
The personal data that are processed in connection with an order placed as a guest of MÁ are processed by MÁ in fulfillment of the contract entered into with you or to carry out pre-contractual measures (Article 6(1)(b) GDPR) and are erased afterwards, to the extent that retention is not prescribed by law. In the latter event, the data are erased upon expiration of the retention period.
4.1.4 Transfer to third parties when ordering
MÁ transmits the necessary data to DHL, DHL Express in order to enable the goods ordered by you to be delivered.
The processing is effected upon the basis of Article 6(1)(b) GDPR.
For payments via PayPal and credit card MÁ also transmits the necessary data to the appropriate credit institution for processing your payment (Article 6(1)(b) GDPR).
5. Deployment of cookies
You can determine yourself, by adjusting the settings in your browser, whether cookies can be implemented and retrieved. For instance, you can completely deactivate the storage of cookies in your browser, restrict it to certain websites, or configure your browser in such a manner that it automatically notifies you as soon as a cookie is supposed to be implemented and requests a response from you. For technical reasons, the full functional scope of this website as well as of the MÁ online shop necessitate allowing cookies.
MÁ does not use any technology that connects user data with the information incidental to cookies.

You are entitled to the right to data portability and the right to object.
